Terms of Service

1. Definitions

"Account" refers to the unique account created for you to access our Service.

"Content" means any text, images, videos, graphics, code, or other materials uploaded, created, or shared through the Service.

"User Content" refers to Content that you upload, create, or provide through the Service.

Beste provides tools for creating and managing landing pages and websites. The Service is continually evolving, and we may add, modify, or remove features at any time.

We may temporarily or permanently suspend the Service for maintenance, updates, or any other reason. We will make reasonable efforts to notify you of significant changes, but we are not obligated to do so.

We use cookies and similar technologies to improve the Service. Your use of the Service constitutes consent to our use of cookies as described in our Privacy Policy.

4. Account Registration and Security

To use certain features, you must create an Account. You may register directly or through third-party authentication services (such as Google or other OAuth providers).

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and complete registration information
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorized access to your Account
• Accept responsibility for all activities under your Account

We are not liable for any loss or damage arising from your failure to maintain account security.

5. Fees and Payment

Certain features of the Service may require payment. We will clearly communicate any applicable fees before you incur charges.

If we change our pricing, we will provide at least 30 days' notice. Your continued use of paid features after a price change constitutes acceptance of the new pricing.

You must provide accurate and complete billing information. We may use third-party payment processors to handle transactions.

Accounts with fees that are more than 30 days overdue may be suspended or terminated.

All purchases are final. We do not provide refunds except as required by law. If your account is set to auto-renewal or is in a trial period, we may automatically charge you at the end of the trial or for renewal unless you cancel beforehand.

6. Your Content and Intellectual Property

You retain all ownership rights to your User Content. We do not claim ownership of anything you create or upload.

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to use and share your User Content
• Your User Content does not violate any laws or third-party rights
• Your User Content does not contain malware or malicious code

You are responsible for backing up your User Content. We are not a backup service and are not responsible for any loss or corruption of your data.

We may review, remove, or refuse to display User Content that violates these Terms or applicable law, but we have no obligation to monitor User Content.

7. License to Your Content

By uploading or creating User Content through the Service, you grant us a limited, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.

This license exists only to enable us to provide the Service to you and ends when you delete your Content or close your Account, except where Content has been shared with others and they have not deleted it.

8. Beste's Intellectual Property

The Service, including its software, design, features, and branding, is owned by Beste Studio LLC and protected by intellectual property laws.

These Terms do not grant you any right to use Beste trademarks, logos, or branding. You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer or decompile any part of the Service
• Resell, lease, or sublicense the Service
• Remove any copyright or proprietary notices

9. Acceptable Use Policy

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload content that is defamatory, obscene, harassing, or promotes violence or discrimination
• Distribute malware, viruses, or other harmful code
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated tools to scrape or collect data from the Service
• Impersonate others or misrepresent your affiliation
• Use the Service to send spam or unsolicited communications
• Upload any sensitive personal information such as social security numbers, financial information, or health data without proper safeguards

The Service is not intended for children under 13. You must ensure that minors do not use the Service without appropriate supervision and consent.

10. Prohibited Website Content and Activities

When you create and publish websites using our Service, you are solely responsible for all content displayed on those websites. You are strictly prohibited from creating, publishing, or hosting websites that contain or promote:

• Illegal Activities: Any content that facilitates, promotes, or engages in illegal activities, including but not limited to drug trafficking, weapons sales, human trafficking, money laundering, fraud, or any other criminal activity
• Harmful or Dangerous Content: Instructions or encouragement for causing physical harm to individuals, animals, or property; promotion of self-harm or suicide; content that endangers children
• Hate Speech and Discrimination: Content that promotes hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Adult and Explicit Content: Pornographic material, sexually explicit content, or any adult content that violates applicable laws
• Gambling and Unregulated Financial Services: Unlicensed gambling services, unregistered securities offerings, pyramid schemes, or fraudulent investment opportunities
• Counterfeit and Stolen Goods: Sale or distribution of counterfeit products, stolen goods, or unauthorized replicas
• Phishing and Scams: Websites designed to deceive users, steal personal information, credentials, or financial data
• Copyright Infringement: Unauthorized distribution or sale of copyrighted material, pirated software, movies, music, or other protected intellectual property
• Harassment and Doxxing: Content that harasses, stalks, or threatens individuals; publication of private personal information without consent
• Misinformation with Intent to Harm: Deliberate spread of false information intended to cause harm, such as fake health claims, election interference, or crisis misinformation

Enforcement and Consequences:

We actively monitor and review websites created through our Service, either through automated systems, user reports, or manual review. If we determine that a website violates these Terms or applicable laws, we reserve the right to:

• Immediately suspend or remove the website without prior notice
• Terminate your Account and access to the Service
• Preserve and disclose website content and user information to law enforcement authorities
• Pursue legal action and seek damages for violations that cause harm to us or third parties
• Ban you from using our Service permanently

You acknowledge that we have no obligation to host, maintain, or provide access to any website that we determine, in our sole discretion, violates these Terms. We may take action based on our assessment without the need to prove actual harm or illegality.

If your website is removed or suspended, you will not be entitled to any refund of fees paid. Repeated violations or severe violations may result in permanent account termination and reporting to relevant authorities.

Reporting Violations:

If you become aware of any website created using our Service that violates these Terms, please report it immediately to hello@beste.co with details about the violation and the website URL. We take all reports seriously and will investigate promptly.

11. Third-Party Services and Links

The Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of these third parties.

Your use of third-party services is at your own risk and subject to their respective terms and conditions.

12. Copyright and DMCA

We respect intellectual property rights. If you believe that content on our Service infringes your copyright, please contact us at hello@beste.co with:

• A description of the copyrighted work
• The location of the infringing material
• Your contact information
• A statement that you have a good faith belief that the use is unauthorized
• A statement that the information is accurate
• Your physical or electronic signature

We reserve the right to remove allegedly infringing content and terminate repeat infringers' accounts.

13. Termination and Suspension

You may stop using the Service at any time. Before terminating your Account, you should download any User Content you wish to retain, as we may not be able to provide access after termination.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if:

• You violate these Terms
• Your use creates legal liability for us
• Your use disrupts the Service for others
• We are required to do so by law

We will make reasonable efforts to notify you before suspension or termination and to help you retrieve your data when possible.

We may experience service interruptions for maintenance, updates, or technical issues. We encourage you to maintain your own backups of important data.

14. Warranties and Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free from viruses or harmful components
• Results from using the Service will meet your requirements

You are solely responsible for any damage to your Device or loss of data resulting from your use of the Service.

15. Limitation of Liability

To the fullest extent permitted by law, Beste Studio LLC, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses, resulting from:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your content
• Any conduct or content of third parties on the Service
• Any content obtained from the Service

Our total liability for all claims related to the Service shall not exceed the greater of $100 or the amount you paid us in the past three months.

17. Dispute Resolution

Informal Resolution

Before filing any formal claim, you agree to first contact us at hello@beste.co to attempt to resolve the dispute informally. We will attempt to resolve the dispute through negotiation for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Jurisdiction

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming. You consent to personal jurisdiction and venue in these courts.

Class Action Waiver

You agree to resolve disputes with us only on an individual basis, and you waive any right to participate in a class action lawsuit or class-wide arbitration.

18. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you via email or through a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service.

19. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Beste Studio LLC regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

Relationship

Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and Beste Studio LLC. We are independent contractors.

Time Limit for Claims

Any claim related to these Terms or the Service must be filed within one year of the date the claim arose, or it will be permanently barred.
